U.S. Supreme Court To Take Up Line 5 Lawsuit

(Washington, DC) – The U.S. Supreme Court will review if the lawsuit filed by Michigan Attorney General Dana Nessel over Enbridge Energy’s Line 5 pipeline belongs in state or federal court. Nessel sued in June 2019 to void the easement allowing Enbridge to build a four-and-a-half-mile tunnel under the Straits of Mackinac for their oil pipelines and move them from the lakebed underground. Enbridge moved the case to federal court in 2021 under the argument it impacts U.S. and Canadian trade with them bringing oil from Superior, Wisconsin to Sarnia, Ontario through the pipeline.

Former Governor Rick Snyder agreed to the pipeline, but under current Governor Gretchen Whitmer, the Department of Natural Resources revoked the easement.
